Whilst “AAYAMs Resorts” seeks to ensure that the Information is reliable and accurate, errors and omissions may occur and therefore, to the extent permitted by law, “AAYAMs Resorts” does not make or give any representation or warranty (express or implied) of any kind as to any matter relating to the website and any linked website, including without limitation, as to merchantability, non-infringement of intellectual property rights or fitness for purpose.

  1. Hotel Reservations

You are legally entitled for entering into any approval and capable to bear the financial burden of any agreement.

For any reservations or other services for which fees may be charged, you agree to abide by the terms or conditions of supply including without limitation payment of the entire amount due under such terms or conditions.

Our offer will contain details of hotel charges and room rates (including any available special offers).

Hotel reservation terms and conditions of booking and cancellations shall be shared along with our offer and payment will be in accordance with the procedure set out in such terms and conditions.

No contract will exist unless and until “AAYAMs Resorts” accepts your order by e-mail confirming that it has accepted your reservation, booking or order and any such contract shall be deemed to incorporate the hotel reservation terms and conditions of booking.

You undertake that all details you provide to in connection with any services or products which may be offered by “AAYAMs Resorts” on the website will be correct and, where applicable, the credit card which you use is your own and that there are sufficient funds to cover the cost of any services or products which you wish to purchase. “AAYAMs Resorts” reserves the right to obtain validation of your credit card details before providing you with any services or products.

  1. General Booking Terms, Cancellation of Bookings, Refunds and Complaints

You agree to pay “AAYAMs Resorts” & it’s holding companies the advance Deposit for any booking requested and confirmed by “AAYAMs Resorts” (only after receiving confirmation by the respective hotel / resort / tour operator). The refund of advance amount is subject to the cancellation policy / terms of the respective hotel / resort / tour operator (the same shall be shared along with the offer). The refund amount shall be refunded back through the same medium within a commercially reasonable time (7-10 business days).  “AAYAMs Resorts” do not refund for missed or unused services.

  1. Unforeseen Circumstances Operator Cancellations and Refunds: If a hotel / resort / tour operator cancels a confirmed booking made through “AAYAMs Resorts”, the advance amount shall be refunded back to the traveler immediately after the receipt of payment refund from the respective hotel / resort / tour operator.

Traveler complaints regarding their experience during their stay shall be passed on to the respective hotel / resort / tour operator. All such complaints will be diligently followed by our team with the respective hotel / resort / tour operator and will be resolved as soon as possible.

  1. Reservations and Amendment

The reservations feature of the Site is provided solely to assist customers in deciding the availability of travel related services and products and to make authorized reservation requests and for no other intent.

You warrant that you are at least 18 years of age, possess the legal authority to enter into the legal agreement constituted by your acceptance of these Conditions and to use the Site in conformity with such Conditions.

All reservations are subject to availability. Reservation requests submitted on this site are considered conditional until a confirmation number is given to the guest to confirm the reservations by email or WhatsApp. The hotel may, from time to time, convey with the guests, to re-confirm the reservations and to prevent any simulated bookings.

The Site contains details of hotel charges and room rates (including any available special offers) for hotels and resorts marketed or managed by “AAYAMs Resorts”. Hotel reservation terms and conditions of booking are set out on the Site and payment will be in agreement with the procedure set out in such terms and conditions.

You agree to be financially liable for your use of the Site including without limitation for all reservations made by you or on your account for you, whether authorized by you or not. For any reservations or other services for which fees may be charged you agree to abide by the terms or conditions of supply including without limitation payment of all dues under such terms or conditions.

No declaration will exist between you and “AAYAMs Resorts” or any of its affiliates in respect of any services or products offered through the Site, unless and until “AAYAMs Resorts” accepts your order by e-mail or automated confirmation through the Site affirming that it has accepted your reservation, booking or order and any such contract shall be deemed to incorporate the hotel reservation terms and conditions of booking.

You undertake that all details you provide to in connection with any services or products which may be offered by “AAYAMs Resorts” on the Site (including hotel room reservations) will be correct and, where applicable, the credit card which you use is your own and that there are sufficient funds to cover the cost of any services or products which you wish to purchase. “AAYAMs Resorts” reserves the right to obtain validation of your credit card details before providing you with any services or products.

  1. Arrival & Departure Policy:

Check- in: 2:00 PM

Check- out: 11 AM

Early check-in is subject to availability. For guaranteed early check-in, room to be reserved from the previous night. Rooms are held until 6 pm on day of arrival unless guaranteed by an advance payment or deposit.

  1. Cancellation Policy:

If you need to reschedule, we’d be happy to assist you. Please keep in mind that rescheduling your reservation is contingent upon room availability. In the event of cancellation of reservation, cancellation charges shall apply. These charges are as under:

Full refund in case the booking is cancelled 16 days before the check-in.

50% of the total booking amount shall be charged as Retention, if the booking is cancelled within 10 to 15 days from the date of check-in.

100% booking amount shall be charged as retention, if the booking is cancelled within 10 days from the check-in date or “No Show” or “Early check out”.

  1. Guarantee Policy:

All bookings must be guaranteed at the time of reservation by an advance payment by Net Banking / UPI.

  1. Child Policy:

One child under 5 years of age can stay in the parents’ rooms free of charge.

  1. Photo Identity:

All Guests are requested to produce the Government Approved photo identity card for Indian Nationals and Valid Passport and Visa for Foreign Nationals upon Arrival.

  1. Security & non-confidentiality

“AAYAMs Resorts” does not warrant and cannot ensure the security or confidentiality of any information which you transmit to it. Accordingly, any information which you transmit to “AAYAMs Resorts” is transmitted at your own risk.

  1. Termination of Access

If you breach any of these conditions your license to use the website will terminate immediately without the necessity of any notice being given to you.

Otherwise access to the website may be terminated at any time by “AAYAMs Resorts” without notice.

The provisions of these conditions excluding, limiting and disclaiming the liability of “AAYAMs Resorts” will nevertheless survive any such termination.

  1. General

“AAYAMs Resorts” does not accept any liability for any failure by “AAYAMs Resorts” to comply with these conditions where such failure is due to circumstances beyond its reasonable control.

If “AAYAMs Resorts” waives any rights available to it under these conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

If any of these conditions are invalid, unenforceable or illegal for any reason, the remaining conditions shall nevertheless continue in full force.

You are completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of the website.

  1. Governing Law & Jurisdiction

These conditions are governed by the laws in force in India and you agree to submit to the exclusive jurisdiction of the courts of India.
